Terms of Service

These terms are an agreement between you and Elenie Marine ("we", "us"), operated from California, USA, covering eleniemarine.com and its business, events, and operations portals (together, "the service"). By creating an account or using the service you agree to them. They include a safety disclaimer, a disclaimer of warranties, and a limit on our liability — please read those sections.

1. Navigation and safety — read this first

Elenie Marine is an aid to situational awareness. It is not a navigation device and is not a substitute for official nautical charts, a proper lookout, safe speed, or your own judgment as operator of a vessel.

Waterway information on the service — hazards, depths, reports, markers, routes — is contributed by users and other sources, can be wrong, incomplete, or out of date the moment conditions change, and is provided without any warranty of accuracy. Water levels, obstructions, and hazards in the California Delta and elsewhere change constantly.

You are solely responsible for the safe operation of your vessel, for complying with U.S. Coast Guard and state boating law, and for every navigation decision you make. You assume all risk of relying on any information in the service. If information in the app ever conflicts with what you observe on the water, trust the water.

2. Your account

You must be at least 13 to create an account — no accounts for children under 13, ever. If you are 13 to 17, you may use the service only with the permission of a parent or guardian who has reviewed these terms with you; they share responsibility for your use. Young boaters are part of life on the water and welcome here — and the whole service is held to a family-safe standard, spelled out in the Community Rules, partly for that reason. Keep your credentials to yourself: you are responsible for what happens under your account, and turning on two-step sign-in is strongly recommended. One account per person. We may suspend or close accounts that break these terms; where reasonable we will say why, and you can reply to contest it.

3. Your content

Reviews, waterway reports, photos, event content, and listings you submit stay yours. You give us a worldwide, royalty-free license to host, display, and moderate them so the service can work. You are responsible for what you post: post only what is true to the best of your knowledge and what you have the right to share. We may remove content that breaks these terms or endangers users, and community safety reports may be kept in anonymized form after you delete your account, as described in the Privacy Policy.

4. Acceptable use

In the Community features, the Community Rules also apply — they are part of these terms, and they set the family-safe content standard and the protections for members under 18.

5. Businesses and event organizers

If you register a business or organize events through the portals, you additionally agree that: information in your listing is accurate and you are authorized to represent the business; verification decisions are ours to make and may be revoked for cause; you are responsible for the participant information you enter — including having permission to publish results that name participants, and especially minors; and you will use participant contact information only to run your event, never for unrelated marketing.

6. Paid placements and payments

Businesses and organizers can buy time-limited promotional placements. Prices are shown before checkout and payment is processed by Stripe on Stripe's own pages — we never see your card details. A placement goes live when payment completes and runs for exactly the window purchased. Refunds: if we end a placement early for our own reasons, we refund the unused time pro-rata; if you withdraw a placement after it has started, the remaining time is not refunded. Placements do not affect the underlying map, reviews, or safety data — paid visibility is always labeled and never alters community information. Ads for age-restricted products (alcohol, tobacco or vape products, cannabis, firearms or ammunition, fireworks, gambling or lottery, and similar) are not accepted: the audience includes minors and the service does not age-target advertising.

7. The service itself

We work on the service continuously; features may change, be added, or be retired. Except for the promises made expressly in these terms, the service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the service will be uninterrupted, error-free, or — per section 1 — that any waterway information is accurate.

8. Limitation of liability

To the maximum extent permitted by law: we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill; and our total liability for all claims arising out of the service is limited to the greater of $50 or the amounts you paid us in the twelve months before the claim. Some jurisdictions do not allow certain limits, so parts of this section may not apply to you. Nothing in these terms limits liability that cannot lawfully be limited.

9. Indemnification

If your content, your business listing, or your breach of these terms causes a third party to bring a claim against us, you agree to defend and indemnify us against that claim, including reasonable legal costs.

10. Disputes

If something goes wrong, contact us first at [email protected] — most problems can be fixed in a conversation, and we ask for 30 days to try before either side files anything. These terms are governed by California law, and disputes belong to the state or federal courts located in California. If any part of these terms is found unenforceable, the rest stands.

11. Privacy

How we handle your data is described in the Privacy Policy, which is part of the deal between us. The short version: we collect the minimum, we sell nothing, and your live GPS position never leaves your device; a trip you choose to keep is saved to your account.

12. Changes to these terms

When we make a material change, we will announce it with an in-app notification (and by email where appropriate) before it takes effect. Continuing to use the service after the effective date means you accept the updated terms; if you do not, you can delete your account at any time under Me → Security. This page always states its version and effective date.
